This Labor Rights Bill Could End Up Hurting Gig Workers

New federal legislation makes the same mistake a California law did, which cost thousands of jobs.

EDITOR’S NOTE: After publication, it came to YES! Media’s attention that this op-ed, concerning the PRO Act as it was introduced in Congress, contained an error concerning the scope and impact of the bill that undermined the main premise of the article. The PRO Act’s ABC test would amend the National Labor Relations Act only—which only concerns union representation, not overall labor law—and therefore would not have the same deleterious effect on contractor employment as California’s AB5 bill, which includes a similar provision. Therefore, YES! Media formally retracted this story at 5 p.m. March 24, 2021. The story was left online in compliance with our standards of transparency and accountability, but after further review and consultation with the author, we removed the article from our website at 10:40 a.m. March 28.
